A new analysis from the Consumer Policy Center examines the influence of commission-based referral services in residential property transactions. The report, authored by the organization's senior fellow and a fellow, asserts that programs operated by major digital real estate platforms contribute to elevated commission rates and affect agent service quality.

The study estimates that a large majority of all home sales involve some form of referral. It highlights fees paid by agents to platforms, which can represent a significant portion of an agent's earnings upon a completed sale, as particularly problematic. The analysis contends that agents surrendering a large share of their commission to referral fees have reduced incentive to negotiate lower overall commission rates with clients.

Furthermore, the report suggests such fee structures could motivate agents to seek higher sale prices to increase their own payout, or to deliver diminished service for lower-value transactions. It also raises concerns that certain online portal features may connect consumers to agents without adequate disclosure of the financial referral arrangement, potentially breaching fiduciary responsibilities.

One author expressed surprise at the scale of consumer risk and cost posed by services charging agents high referral percentages, describing the rates as excessive while clarifying opposition is not to referral fees in principle. The report names one platform as the most notable operator of such programs, noting it facilitates millions of annual buyer connections and accounts for a portion of all home sales transacted via its site.

The platform in question has challenged the report's findings. A company representative stated the analysis lacks substantiating evidence and depends on unverified online sources. The response characterized referral fees as a standard business expense for marketing, comparable to traditional advertising costs, and asserted no proof exists linking such fees to commission levels. The company also maintained that the consumer experience is not adversely affected when clients are connected to its network of agents, whom it describes as high-performing.
