Lawsuit Challenges USDA's 2024 Electronic Cattle ID Rule

A legal advocacy group, with backing from a cattle industry organization, has petitioned a federal court to overturn a regulation from the U.S. Department of Agriculture. According to Meat+Poultry, the rule mandates electronic identification tags for cattle and bison moved interstate.

The lawsuit was presented in a federal district court in South Dakota. The USDA established this mandate in 2024.

The plaintiffs argue that the agency previously accepted visual-only tags as effective for disease tracking and allowed producers a choice between tag types. They state the USDA now asserts electronic tags and records are superior without providing supporting evidence or rationale for this shift.

The filing further contends the department has not acted to resolve purported issues with the long-standing visual tag system. It notes the current rule does not compel producers to purchase electronic readers, meaning the more expensive electronic tags are often used in the same manner as the cheaper visual ones.

The core legal argument presented is that the USDA failed to adequately justify its reversal on the sufficiency of visual-only tags for traceability, a change they claim required detailed explanation.
