IRS Staffing Shortage Complicates New Tax Law Filing Season

The IRS is operating with roughly 27% fewer employees this tax filing season than it did last year. Last July, a major new tax law took effect, containing many new provisions affecting individuals for tax year 2025.

Tax professionals indicate the filing season has presented challenges for both preparers and clients.

Clarifying New Tax Breaks

Three widely promoted tax breaks concerning overtime, tips, and Social Security have been described inaccurately as eliminating tax on that income. For Social Security, the law did not alter taxability but instead provides an additional deduction of up to $6,000 ($12,000 for joint filers) for individuals over 65, subject to income limits.

The breaks for tips and overtime function as deductions, not credits, meaning they only reduce taxable income by a percentage. These deductions apply only to qualified tips in certain industries and a portion of qualified overtime, with calculations being complex.

Confusion Over Benefit Amounts

Many filers misunderstand the financial impact of these deductions. Some mistakenly believe the overtime break is a credit that would reduce their tax bill dollar-for-dollar. In reality, the deduction only lowers taxable income, so the actual tax savings depend on the filer's top tax rate.

While the IRS has disseminated information on the new rules, guidance remains subject to revision. Recently updated rules for the tips deduction introduced a new qualifying element for self-employed individuals, resulting in a smaller break than initially anticipated.

Further uncertainty exists regarding the documentation required to support claims. The W-2 form for 2025 was not altered to include taxable tips and overtime reporting, making employer reporting optional until next year.
