EU Industrial Accelerator Act: Aims to Boost Low-Carbon Production, Faces Industry Criticism

The European Commission has introduced the Industrial Accelerator Act. The framework aims to boost demand for low-carbon technologies and products made in Europe, with a goal of raising industrial production's share of the bloc's GDP to 20% by 2035.

Key Provisions and Sector Focus

The act establishes requirements for a Made in Europe program and sets low-carbon criteria for public procurement and state aid. These rules will apply to strategic sectors such as steel, cement, aluminum, automotive, and zero-emission technologies. Products from partners with a free trade agreement or customs union with the EU, or who are parties to the WTO Agreement on Government Procurement, will be treated as originating in the bloc for these measures.

The framework is designed to ensure equal treatment from countries that grant reciprocal market access to EU companies. It also sets conditions for large investments in strategic sectors from third countries that hold over 40% global market share in that sector, including limits on foreign capital participation and requirements for local content and European employment levels.

Steel Industry Reaction and Criticisms

European steel associations have expressed dissatisfaction with the proposal. They criticize the lack of a requirement that low-carbon steel for public procurement be produced within the EU, a point highlighted by both the European Steel Association and the German Steel Association. Industry representatives argue this undermines investment security and weakens Europe's industrial position.

Further criticism from national steel associations focuses on weak definitions of European origin for steel, uncertainties in classifying low-carbon steel, and the treatment of products from third countries with trade agreements as equivalent to EU-origin goods. One major steel producer stated the act promotes imports over the use of European steel, supporting investment outside Europe.

International Responses and Concerns

China's government has expressed serious concern about the act, stating it imposes restrictions on foreign investment in sectors like batteries, electric vehicles, solar photovoltaic systems, and critical raw materials. China views the use of industrial development and green transition goals as protectionist and plans to monitor the legislative process.

Conversely, the criteria for equivalent products have reassured some trading partners. Turkey anticipates being considered under the Customs Union arrangement and sees potential benefits for its steel and automotive sectors. The United Kingdom notes that current draft provisions include derogations that would apply to it, alleviating some initial fears of exclusion from EU supply chains.

South Korea has convened a meeting with affected industries to assess the act's impact. While recognizing its inclusion via a free trade agreement, it expressed concern about EU requirements for electric vehicle subsidies, viewing them as violating reciprocity principles.

Broader Industry Feedback and Next Steps

The proposals have drawn mixed reactions from other sectors. An industry group for hydrogen believes the act does not send a strong enough demand signal to unlock necessary investments. Automotive industry associations have pointed to potential loopholes in requirements for electric vehicle parts. A major business organization stated it would impartially consider the introduction of European preferences in line with other regulations.

The Industrial Accelerator Act must now be agreed upon by EU member states and the European Parliament before becoming law, and the proposals remain subject to change.
