2026 Funding Bill Boosts Right Whale Conservation and Fishing Industry Support

According to SeafoodSource, U.S. lawmakers have maintained a focus on resolving conflicts between the New England lobster industry and the endangered North Atlantic right whale. The whale population, which faced a significant decline and reached a low point in 2020, has been in a period of elevated mortality since 2017. Regulatory actions intended to aid the species have conflicted with commercial fishing operations, which have faced criticism over whale entanglements and ship collisions.

A pivotal biological assessment from NOAA Fisheries in 2021 called for strict new rules for lobster fishing to prevent extinction, but its methodology was challenged in court. A federal judge later invalidated that assessment in 2023, finding the agency had improperly relied on worst-case projections, thereby removing the mandate for the stricter regulations.

Since that court decision, legislators have acted to prevent new regulations on the lobster industry while directing substantial funding toward reducing entanglements, supporting whale recovery, and preventing vessel strikes. Provisions to address these challenges were included in a broader funding package for NOAA Fisheries and the Department of Commerce in January 2026.

The legislation specifies 51 million U.S. dollars for research, monitoring, and conservation work related to right whales, representing an increase of 4 million dollars over previous spending levels. Congressional guidance indicates these funds should support innovative fishing gear research, acoustic and satellite monitoring, and activities like whale disentanglement and necropsy.

Within that total, 30 million dollars is designated for the Atlantic States Marine Fisheries Commission to test or voluntarily implement new gear to lessen entanglements, and for monitoring whale habitats and developing alternative population models. A U.S. Senator from Maine stated the funding aims to improve scientific data that informs regulations, which have been viewed as overly burdensome for the state's lobster industry.

The law further urges NOAA Fisheries to cease using worst-case scenarios in its evaluations of the whale population. The Senator from Maine has previously questioned whether an executive order from the current President of the United States, which emphasizes rigorous science, would prevent the reuse of such analytical methods. The Secretary of Commerce affirmed the administration's commitment to using what it describes as real science and to protecting fishing interests.

Additional investments in the bill include 5 million dollars for a pilot program offering near real-time monitoring of large whales to avoid ship strikes. Furthermore, 500,000 dollars in directed funding was secured for an organization in Georgia to transmit data on seasonal whale management areas to vessels using existing identification technology. A U.S. Representative from Georgia and the head of the conservation group involved both noted that this investment helps protect the whales, which use coastal Georgia waters as a calving ground, while also supporting maritime safety and economic activity.

Following the 2020 population low, whale numbers have shown a modest increase over the subsequent five years. An estimate from October 2025 reported 384 individuals, reflecting growth. Despite this improvement, a prior NOAA analysis warned that the species faces extinction unless entanglements and vessel strikes are greatly diminished.
